Terms of service

Octotune is free to start. A grown-up is responsible for a child's use, and only grown-ups have accounts. Octotune Plus, an optional subscription, is sold through Link, by Stripe, which handles the payment, tax, receipts and refunds. You can cancel it at any time.

These terms are the agreement between you and Octotune when you use the Octotune app at octotune.com/play or this website. By using Octotune, you agree to them. If you don't agree, please don't use it.

The short version

• Octotune is free to start. You don't need an account or payment details to play.
• Grown-ups are in charge. Kids mode is for children with a grown-up, who is responsible for the child's use. Children never sign in or give personal information.
• Accounts are optional, and for grown-ups only.
• Octotune Plus is optional. Only a signed-in grown-up can buy it. It is sold through Link, by Stripe, which handles the payment, tax, receipts, billing help and refunds.
• Plus renews automatically until you cancel. You can cancel at any time, and it ends when the period you have paid for ends.
• No ads, and no analytics. Privacy explains what is kept and where.
• Octotune is a learning aid. It isn't a piano teacher.
• You keep your rights. Nothing here takes away the rights that consumer law gives you where you live.

Who we are

Octotune is run by a sole proprietor business in Texas, United States. In these terms, "Octotune", "we" and "us" mean that business. "You" means the person using Octotune. You can reach us at the address under Contact.

Using Octotune

Octotune runs in your web browser, and you can install it from there as an app. You can use it without an account. Your progress is kept on your device.

If you are not yet an adult, a parent or guardian needs to agree to these terms for you.

Children and grown-ups

Kids mode is for children from about 2½, used with a grown-up.

• A grown-up is responsible for a child's use of Octotune. That includes deciding whether a child uses it, for how long, and on which device.
• Children never sign in, and are never asked for personal information. Kids mode has no names, no profiles, no chat and nothing to buy.
• Anything a grown-up might change sits behind a hold. Signing in, backups and settings are kept away from the screens a child uses.

Accounts

Signing in is optional, and accounts are for grown-ups only. Today you sign in with Google. Other ways to sign in, such as Apple, may be added later.

• Your sign-in belongs to Google (or whichever service you sign in with). Keep that account secure. You are responsible for what is done with your Octotune account.
• A signed-in account keeps a copy of the progress on the devices you sign in on, for both Kids and Adult. Privacy explains what is kept.
• You can delete your account at any time in the settings. Deleting it does not cancel Octotune Plus: cancel that first (see below).

Octotune Plus

Octotune Plus is an optional paid subscription that adds extras to the app. What it includes and what it costs are shown before you buy.

Who can buy it

Only a grown-up who is signed in, in Adult mode, can buy Octotune Plus. It is never offered or sold in Kids mode. Plus belongs to the account that bought it: signing in with a different account doesn't bring it along.

Who sells it

Octotune Plus is sold through Link, by Stripe. Link is the reseller and the merchant of record: it sells Plus to you, and it handles:

• the payment and your payment details (Octotune never sees your card);
• sales tax, VAT and GST;
• receipts and invoices;
• help with billing;
• refunds.

At checkout you will see "Sold through Link", and your card statement will read LINK.COM* OCTOTUNE. The checkout starts on a page run by RevenueCat, which keeps track of who has Octotune Plus, and continues on Stripe's checkout.

Link's and Stripe's own terms also apply to your purchase. You will see them at checkout. Where they speak about the payment, billing or refunds, they are the ones that decide.

Billing, trials and renewal

• Monthly or yearly. You choose how often to pay. The checkout shows the price and any tax before you pay.
• Free trials. Plus may come with a free trial. The checkout says how long it lasts. Unless you cancel before it ends, your subscription starts and you are charged when the trial ends. For a longer trial, Link sends a reminder before it ends.
• Automatic renewal. Your subscription renews at the end of each month or year, and you are charged again, until you cancel.
• Price changes. If the price changes, we will tell you before the new price applies to you, so that you can cancel first if you want to.

Cancelling

You can cancel at any time:

• in the app, under "Manage subscription" in your account settings; or
• on Link's website, app.link.com.

Cancelling stops the next renewal. You keep Plus until the end of the period you have already paid for, and then it ends. Cancelling doesn't, by itself, refund that period.

Refunds

Refunds are handled by Link, under its terms. In some cases, Link can refund a payment made within the last 60 days. Where the law where you live gives you a right to cancel or a cooling-off period, Link applies it.

To ask for a refund, contact Link through app.link.com or the links in your receipt. You can also contact us, and we will help.

Your privacy

Octotune has no ads and no analytics. Your progress is kept on your device. If a grown-up signs in, a copy is also kept in their account, so that it is the same on every device they use. The privacy page explains exactly what is kept, where, and who else is involved.

Using Octotune fairly

Please use Octotune the way it is meant to be used. Don't:

• break the law, or anyone else's rights, while using it;
• try to get into someone else's account or data;
• try to get around the parts of Octotune that need Octotune Plus, or its security;
• overload, disrupt or attack the app, the website or the services behind them;
• copy or scrape the app, its lessons or its song library to sell them or to build a service of your own;
• take the app's code apart, except where the law allows you to;
• use automated tools to make accounts or purchases.

Your licence to use Octotune

We give you a personal, non-exclusive, non-transferable licence to use Octotune for your own learning and your family's, as long as you keep to these terms. We can end it if you don't (see Ending).

The app, its code, its lessons and pictures, the octopus, the name "Octotune" and our own song arrangements belong to us or to the people who license them to us. These terms don't give you any other rights in them. Please don't use the name or the octopus in a way that suggests we endorse you.

Music and your own files

The song library. The classical pieces are public-domain works typeset by volunteers of the Mutopia Project. Some are shared under Creative Commons licences (CC BY or CC BY-SA). Every piece is credited on its own page, with its composer, its typesetter and its licence. Those licences apply to those pieces, and nothing in these terms limits what they allow you to do. The children's songs are public-domain tunes in Octotune's own arrangements.

Your own files. You can open your own MIDI or MusicXML files in Songs. They stay on your device and are never uploaded. You are responsible for having the right to use them. We don't claim any rights in them.

A learning aid, not a teacher

Octotune helps you practise reading music and playing it. It is not professional music instruction. It can't see your posture or your hands, and it doesn't replace a teacher. Take breaks, and if playing hurts, stop and rest. How quickly anyone learns depends on many things, so we can't promise any particular result.

Changes to Octotune

We work to keep Octotune running well, but we can't promise it will always be available or free of mistakes. We may change it: add, change or remove features, lessons or songs, or stop offering part of it or all of it. If we stop offering Octotune Plus, we will stop the renewals and tell subscribers beforehand, where we can.

Progress kept in your browser can be lost if the browser's data is cleared. Save a backup from the settings now and then, or sign in to keep a copy in your account.

Ending

You can stop at any time. Stop using Octotune, delete your account in the settings, and clear this site's data in your browser. If you have Octotune Plus, cancel it as described above: deleting your account doesn't cancel it.

We may suspend or close an account if someone seriously or repeatedly breaks these terms, or if the law requires us to. Where it is reasonable, we will tell you first and explain why.

The parts of these terms that are meant to last, such as "Disclaimers", "Limits on our liability" and "The law that applies", still apply after they end.

Disclaimers

As far as the law allows, Octotune is provided "as is" and "as available". We don't promise that it will meet every need, work on every device or keyboard, be available without a break, or be free of errors.

This doesn't affect any rights you have that the law says can't be taken away, such as your rights as a consumer where you live.

Limits on our liability

As far as the law allows:

• we are not responsible for loss or damage that could not reasonably have been foreseen;
• Octotune is for personal use, so we are not responsible for business losses;
• our total responsibility to you for any claim about Octotune is limited to the amount paid for Octotune Plus on your account in the 12 months before the claim.

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.

The law that applies

These terms are governed by the laws of the State of Texas and of the United States. Any dispute goes to the state or federal courts in Texas.

If you are a consumer, you keep the protection of the law where you live. For example, consumers in the European Union and the United Kingdom keep the rights that their own law gives them and that can't be changed by agreement, and can bring a claim in their own courts.

If something goes wrong, please contact us first. Most problems can be sorted out quickly.

Changes to these terms

We may update these terms, for example when Octotune changes or the law does. The date at the top shows when they last changed. If a change matters, we will let you know in the app before it applies. A change never applies to a period you have already paid for. If you don't agree with a change, you can stop using Octotune and cancel Octotune Plus.
